Our building has rules that prohibit bikes from being transported in the elevators or wheeled in the corridors and lobby areas of the building in order to prevent damage to the common elements and to avoid overcrowding and inconvenience to others travelling in the elevators. In addition, also the storage of bicycles (and other items) on the units’ balconies prohibit. The rules bind all owners, tenants and other residents. Although the rules bind tenants, tenants do not have any standing to cause the condominium rules to be amended. The condominium manager is not at liberty to change or disregard the rules.

USE OF BICYCLES AND BICYCLE STORAGE UNITS:

(a)Bicycles are not permitted to be taken through the lobby, corridors or elevators or any other part of the interior Common Elements and may not be stored in Units. Residents must transport their bicycles using the parking garage driveway, and must exit the building using the P1 parking garage exit.

(b) Bicycles must not be stored or parked on any part of the Common Elements not designated for bicycle storage, including exclusive use Common Elements, such as hallways, balconies, terraces and patios.

(c) Bicycles are to be kept in designated areas only, including the bicycle storage units located in the garage and lock-up bike racks installed within specified parking units, and any other areas designated by the Board from time to time.

(d)Each bicycle storage unit on the ground floor shall be used and occupied for storage purposes only which shall not constitute a nuisance or danger. No one shall do or permit anything to be done in a bicycle storage unit, or bring or keep anything therein, which will in any way increase the risk of fire or the rate of fire insurance in the Building or which would increase the risk of an infestation of pests, insects, vermin or rodents in the bicycle storage area on the ground floor.

(e) If any damage is caused to the Common Elements as a result of bicycle use by a Resident or visitor, any costs incurred by the Corporation as a result shall be borne and paid for by the Resident and/or Owner and all payments pursuant to this Rule are recoverable pursuant to these Rules.

(f) For safety reasons, bicycles are strictly prohibited from being ridden up or down garage ramps or within the parking garage.

(g)Bicycles stored in the bicycle storage room on the ground level at 23 Carlton St. must be registered with the property management and affixed to a numeric location assigned to the bicycles.

(h) Bicycles stored in the bicycle storage room on the ground level at 23 Carlton St. must be kept in the manner consistent with the bicycle lockup requirements as established by the shared facilities:

  1. One bicycle per lockup; and,
  2. The primary use is to be frequent day to day use and not long-term storage.

(i) Any bicycles affixed to a lockup not registered with the property management and/or affixed to a numeric location not assigned to the bicycle will have the lock cut and the bicycle removed and held by property management for thirty (30) days. Stored bicycles not claimed for thirty (30) days will be disposed of in a manner determined by the Board.
